Statement by the TNRD on Notice of Civil Claim

Kamloops, BC – June 22, 2023 – In response to multiple inquiries, the Thompson-Nicola Regional District (TNRD) would like to offer clarity in regard to a Notice of Civil Claim filed on June 16, 2023, and explain that no lawsuit has been initiated.

The Notice of Civil Claim was filed by the Municipal Insurance Association of BC (MIABC), which is the property insurer for the TNRD and Village of Lytton. As the insurance provider, MIABC will pay out damages to the TNRD and Village of Lytton for insured losses that have been suffered as a result of the Lytton fire on June 30, 2021.

After paying out the TNRD and the Village of Lytton claims, the MIABC has the right to subrogation, where they can seek reimbursement from any at-fault parties. The statute of limitation period for civil claims claim is (2) years, and the MIABC has filed this Notice of Civil Claim to extend the timeline by an additional year, up to June 30, 2024, to potentially recover costs from any party that may be deemed to be at fault that are named in the Notice of Civil Claim.

None of the defendants named in this Notice of Civil Claim have been served, meaning that no legal action has been commenced by the TNRD or Village of Lytton.

The TNRD owns the property in Lytton that housed the Village’s municipal offices and the TNRD library prior to the Lytton fire. Other losses have been incurred by the Village of Lytton within the municipality’s boundaries as a result of the fire.
